Immigration law likely up to Supreme Court

The court injunction blocking enforcement of Arizona’s immigration law produced winners and losers, but only for the short term. The court has yet to rule on the constitutionality of the law.

Courts have various and specific criteria for injunctions, but in most cases, they prevent action from occurring until courts rule on the merits of the issue before them. U.S. Judge Susan Bolton issued the injunction but will not rule on the underlying issue for some time. Whatever her ruling, it will likely be appealed again and again, until the U.S. Supreme Court weighs in.

This will be a case of states’ rights versus the power of the federal government and will give conservatives and liberals a chance to return to their classic positions, with liberals favoring federal power and conservatives siding with states. And though it’s months or years away, who wouldn’t be surprised if the issue is ultimately settled in a 5-4 Supreme Court ruling with the decision resting on the shoulders of Justice Anthony Kennedy?
